7. Statutory Right of Withdrawal
Subject to the exceptions described in section 8, a Privileged Buyer has the right to withdraw from a distance contract concluded through the Store within 14 days without giving any reason.
The 14-day period begins:
- on the day on which the Privileged Buyer, or a third party indicated by the Buyer other than the carrier, takes possession of the goods; or
- in the case of multiple goods delivered separately, on the day on which the Buyer, or the indicated third party, takes possession of the last item, lot or part.
To exercise the right of withdrawal, the Privileged Buyer must inform the Seller of the decision by an unequivocal statement, for example by post or email, using the contact details in section 2.
The model withdrawal form provided at the end of these Terms may be used, but it is not mandatory.
It is sufficient to send the notice of withdrawal before the 14-day withdrawal period expires.
Effects of withdrawal
If a valid withdrawal is made:
- The Seller refunds all payments received from the Privileged Buyer, including the cost of the standard delivery method offered by the Seller, except for any additional costs resulting from the Buyer choosing a more expensive delivery method than the least expensive standard method offered.
- The refund is made without undue delay and no later than 14 days from the day on which the Seller is informed of the decision to withdraw.
- The refund is made using the same payment method used in the original transaction unless the Buyer expressly agrees to another method. The Buyer will not be charged a fee for the refund.
- Unless the Seller has offered to collect the goods, the Seller may withhold the refund until the goods are received back or until the Buyer provides proof that the goods have been sent back, whichever occurs first.
- Returned goods should be sent to:
PIOTR ZYLBERT MUSIC
Stodolna 76
97-500 Radomsko
PolandThe goods must be sent back without undue delay and in any event no later than 14 days from the day on which the Buyer informed the Seller of the withdrawal. The deadline is met if the goods are sent before the 14-day period expires.
- The Privileged Buyer bears the direct cost of returning the goods in an ordinary withdrawal.
- The Buyer is responsible only for any reduction in the value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
- If a product cannot normally be returned by post because of its nature, information on the estimated return cost will be provided in the product description or during checkout.
- Refunds for card transactions are made to the account linked to the payment card used for the transaction.
8. Exceptions to the Right of Withdrawal
The statutory right of withdrawal does not apply in the cases provided by applicable law, including in particular agreements concerning:
- non-prefabricated goods made to the Buyer’s specifications or serving the Buyer’s clearly personalised needs;
- goods that deteriorate or expire rapidly;
- sealed goods which cannot be returned for health-protection or hygiene reasons once unsealed;
- goods which, after delivery and because of their nature, become inseparably combined with other items;
- sealed audio or video recordings or sealed computer software once the sealed packaging has been opened after delivery;
- newspapers, periodicals or magazines, except subscription contracts;
- goods or services whose price depends on fluctuations in the financial market outside the Seller’s control.
For Piotr Zylbert Music physical CDs, this means in particular that the statutory withdrawal right may be excluded after the sealed packaging of an audio recording has been opened.
9. Complaints and Goods Not in Conformity with the Contract
General rules
The Seller is responsible to a Privileged Buyer for conformity of the goods with the contract as required by applicable law, in particular the Polish Consumer Rights Act.
Complaints, including complaints concerning the operation of the Store, may be submitted by post or email using the contact details in section 2.
The Seller responds to a complaint within 14 days of receiving it.
If a product is covered by an additional commercial guarantee, information about that guarantee and its conditions is provided in the Store.
Privileged Buyers – goods not in conformity with the contract
Where goods are not in conformity with the contract, the Privileged Buyer may exercise the rights provided by the Consumer Rights Act.
In particular, the Buyer may request:
- repair; or
- replacement.
In the circumstances provided by law, the Buyer may also request:
- a price reduction; or
- withdrawal from the contract.
The Seller is responsible for lack of conformity existing at the time of delivery and discovered within two years from delivery, unless a longer applicable period is provided by law or the product’s declared durability.
Where goods are to be repaired or replaced, the Buyer must make them available to the Seller. The Seller bears the cost of collecting the goods.
A Privileged Buyer may not withdraw from the contract on the basis of non-conformity where the non-conformity is insignificant.
Where a contract is terminated because goods are not in conformity, the Buyer returns the goods at the Seller’s cost. The Seller refunds the price without undue delay and no later than 14 days after receiving the goods or proof that they have been sent.
